Terms & Conditions.

Please note: A detailed version of these terms, including statutory rights and cancellation periods, is available in the full Client Agreement. This will be provided for review and signature prior to service commencement.

1. Scope of service

The Saxon Group is a buyer-focused property consultancy designed to support clients through the entire property acquisition journey. I work one-to-one with serious buyers, offering: A structured 6-stage process: Brief, Research, Viewings, Due Diligence, Offer & Negotiation, Completion. Sourcing of on-market and off-market properties based on your needs. Pre-vetting of all properties to save time and avoid unsuitable viewings. Due diligence support, including planning checks, resale potential, and professional referrals. Strategic offer handling, negotiation, and communication with selling agents. Ongoing support through to exchange and completion, with a single point of contact throughout. This service is tailored around your unique goals, whether you're buying a personal home, investment property, or a long-term project. Where required, additional services (e.g., feasibility analysis, introductions to architects, surveyors, or solicitors) may be included based on your package. Before I can begin acting on your behalf, a formal Client Agreement must be signed. This agreement will include these terms, plus additional details specific to your project. You will also be required to complete an ID verification check and provide either proof of funds or a valid Mortgage in Principle (MIP).

2. Fees & Payment

Retainer: A non-refundable retainer is required before services commence. This retainer covers onboarding, client briefing, property sourcing, research, and early-stage consultation. The standard term for a retainer is 6 months. Success-Based Fees: Residential consultancy includes a success fee, due on exchange of contracts. The fee structure is agreed in writing prior to engagement and is 1% (Minimum of £2000).  For high-value or commercial purchases, bespoke fee arrangements may apply. Payment Terms: All invoices are payable within 7 days of issue. Late payments may incur interest or administrative fees unless agreed otherwise.

3. Retainer Terms

The retainer activates our working relationship and secures time for your project. It ensures I can begin sourcing and vetting properties aligned to your brief. The retainer does not guarantee a purchase within the term, but ensures full service throughout the agreed period. If no property is acquired within 6 months, a review will take place to decide whether to renew or conclude the relationship.

4. Cancellations & Refunds

You may cancel the service at any time by providing a minimum of 7 days' written notice. This allows time to cancel any appointments or viewings already arranged on your behalf. The retainer remains non-refundable regardless of when cancellation occurs. In exceptional cases (e.g., major life changes), cancellation requests may be reviewed on a case-by-case basis. If you proceed to purchase a property introduced through The Saxon Group after cancellation, the success fee remains payable. By agreeing to work with The Saxon Group, you also agree that any properties sourced, introduced, or recommended to you — and any advice or insight shared — may not be acted upon, purchased, or used either directly or indirectly for a period of 12 months following cancellation. This is to protect the integrity of the service and ensure fair compensation for work carried out.

5. Confidentiality

All client information is handled in strict confidence. Your property preferences, financial details, contact information, and project notes are never shared without your consent. Where third-party professionals are engaged (e.g., architects, lawyers), information will only be shared after you've approved their involvement. Discretion is fundamental — especially when sourcing off-market properties or working with high-net-worth clients.

6. Professional Referrals

Independent Professionals: The Saxon Group may recommend third-party service providers such as solicitors, mortgage advisors, surveyors, architects, or tradespeople. These referrals are offered in good faith based on our experience or client fit, but all third parties operate independently and are not affiliated with The Saxon Group.

Client Due Diligence: Clients are encouraged to conduct their own due diligence before instructing any referred professional. The Saxon Group accepts no responsibility or liability for the performance, advice, or outcomes of any third-party service.

No Obligation: Clients are under no obligation to use any recommended third-party services. You are entirely free to choose your own advisors or service providers.

Referral Fees & Transparency: On occasion, The Saxon Group may receive a referral fee or commission from third-party providers. Where this occurs, it will be disclosed to the client in advance in writing, in accordance with industry guidelines.

Service Standards: While we aim to recommend only reliable and professional contacts, The Saxon Group cannot guarantee their availability, timelines, or quality of service. All contractual arrangements and obligations lie strictly between the client and the third-party provider.

Complaints: Any concerns about third-party service providers should be addressed directly with the provider. However, The Saxon Group welcomes feedback and may reconsider future referrals based on client experiences.

7. Limitation of Liability

While I act with diligence, care, and professionalism, property transactions involve third parties and external factors beyond my control. I cannot guarantee specific outcomes such as price, speed of transaction, or decisions made by sellers. The Saxon Group is not liable for legal issues, failed purchases, vendor withdrawal, or inaccurate information supplied by third parties. Any property advice provided is not legal or financial advice and should be considered alongside professional consultation.

8. Use of This Website

All content, images, and resources on this website are owned by The Saxon Group unless otherwise credited. The information is for general guidance only and does not constitute legal, investment, or financial advice. Engaging with this site does not create a client relationship unless a formal agreement has been signed. You may not copy, reproduce, or distribute any content without written permission.

9. Privacy & Data Use

At The Saxon Group, your privacy is treated with the utmost care. This section outlines the type of personal information I may collect from you, why it is needed, how it is stored, and how it complies with UK data protection legislation — including the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018.
What Information I Collect:
- Your name
- Email address, and telephone number
- Your property preferences, budget, and specific project requirements
- Your current address and, where necessary, verification of your identity
- Any documents or forms required for sourcing properties or conducting due diligence
- Notes and records of our communications and consultations
- Anonymous website usage data collected via cookies or analytics tools
Why I Collect This Information:
- To provide a tailored, professional property consultancy service
- To verify your identity and safeguard both parties throughout the process
- To comply with legal obligations such as anti-money laundering (AML) requirements
- To ensure accurate communication and maintain a secure service record
- To help improve service quality and business efficiency over time
How Your Data Is Stored:
-All data is securely stored using cloud-based platforms
- Access is strictly limited to myself and any trusted third-party service providers (such as email or CRM platforms) necessary for delivering services
Legal Basis for Processing:
Your personal data will be processed under the following lawful bases:
- With your explicit consent
- Where necessary to fulfil our contract
- Where required to comply with legal obligations
- For legitimate business interests, such as fraud prevention and professional service delivery
Sharing Your Information:
- I will only share your data with trusted third-party professionals or service providers when required to fulfil your brief, and only with your approval
- Your information will never be sold or distributed for marketing or any other unrelated purpose
- Your Rights: Under UK data protection law, you have the right to:
- Access the personal information I hold about you
- Request corrections to inaccurate or incomplete data
- Request the deletion of your data (unless I am legally required to retain it)
- Withdraw your consent to data processing
- Lodge a complaint with the Information Commissioner’s Office (ICO) if you believe your data is being misused

10. Contact & Communication

You can contact me Monday to Friday between 9:00 AM and 7:00 PM. Communication may be via phone, email, messaging, or video call depending on your preference. All conversations and agreements will be documented for clarity and future reference. I aim to respond to all client messages within 24 hours on working days.

11. Client Responsibilities

Clients are expected to provide accurate and timely information. Any intentional withholding or misrepresentation of key information may result in service suspension or termination. You agree to remain responsive and collaborative throughout the process.

12. Intellectual Property

Any written material, sourcing strategy, visuals, documents, or frameworks I create remain the intellectual property of The Saxon Group. These materials are for your personal use only and may not be reproduced, shared, or used commercially without written consent.

13. Non-Circumvention

By entering into an agreement with The Saxon Group, you agree not to bypass, circumvent, or directly engage with any property vendor, representative, or professional (such as architects, surveyors, or planning consultants) introduced by The Saxon Group, in a manner that would result in The Saxon Group being excluded from a fee, commission, or commercial benefit that would otherwise be due. This restriction remains in effect for a period of 12 months following the termination or conclusion of our working relationship. You remain free to engage other estate agents or advisors for unrelated matters. However, if you proceed—whether directly or through another party—with any opportunity introduced by The Saxon Group, our agreed fee or commission will remain payable in full. Example (for clarity only):If The Saxon Group introduces you to an off-market development site and you later contact the landowner directly (or through another agent) and proceed to purchase the property without our involvement, our entire agreed sourcing fee would still be due in full. This is a representative example only and does not limit the scope of this clause to that scenario. The Saxon Group reserves the right to enforce this clause and recover any lost earnings or damages resulting from circumvention.

14. Conflict of Interest

I take steps to avoid conflicts of interest by working with a limited number of clients in overlapping areas. If a potential conflict arises, I will disclose it immediately and discuss options with you.

15. Suspension or Termination of Service

I reserve the right to suspend or terminate services at any point if terms are breached or the working relationship becomes unviable.In such cases, any outstanding fees for services already delivered remain payable.

16. Amendments to Terms

These Terms may be updated periodically. You will be notified of any significant changes in writing or via email.

17. Force Majeure

I am not liable for delays or service disruptions caused by events outside my control, such as natural disasters, illness, or government restrictions.

18. Jurisdiction

These Terms are governed by the laws of England and Wales. If you have any questions about these Terms & Conditions or the way I work, feel free to get in touch before we begin. I believe in full transparency — so you can move forward with clarity and confidence.
